Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you and LeyLance, a sole proprietorship based in Ontario, Canada (“LeyLance”, “we”, “us”, or “our”) governing your use of the Ervun mobile app, the Ervun Windows agent, and the website at ervun.com (together, the “Service”).

Please read carefully. By creating an account, installing the Ervun agent, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. Two points matter most: (1) you may only use Ervun on devices you own or are clearly authorized to control, and (2) because Ervun is zero-knowledge, we cannot recover your passphrase or your encrypted data if you lose it. If you do not agree, do not use the Service.

You must be at least 16 years old (or the age of majority/digital consent in your jurisdiction, and in any case at least 13) and able to form a binding contract to use the Service. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

2. The Service

Ervun is a zero-knowledge, consent-based anti-theft and remote-control system. It lets you enroll devices you own and remotely lock, locate, capture (screenshot/webcam), transfer files to and from, message, schedule actions on, and — if necessary — wipe those devices, using a controller app on your phone. Cryptographic operations happen on your devices; our servers act as an encrypted relay and cannot read your protected content. See our Privacy Policy for details.

3. Authorized use only

Ervun may be used only on devices you personally own, or that you have explicit, informed authorization from the owner to control.

You must not use Ervun to access, monitor, track, capture from, or control any device or person without the owner’s knowledge and consent. Using Ervun for stalking, covert surveillance, harassment, or to control a device belonging to someone else without authorization is strictly prohibited, may be a serious crime, and will result in immediate termination and, where appropriate, referral to law enforcement.

You are solely responsible for ensuring your use of Ervun is lawful in your jurisdiction and that you have the right to control every device you enroll.

5. Your account and passphrase

You are responsible for maintaining the confidentiality of your account credentials and passphrase, and for all activity under your account. Notify us promptly at support@ervun.com if you suspect unauthorized access.

Your passphrase cannot be recovered. Ervun is zero-knowledge by design: your passphrase and encryption keys never reach our servers in usable form. This means neither you nor we can reset or recover your passphrase, and if you forget it, your encrypted vault and files will be permanently inaccessible. You accept this risk as a condition of using the Service.

6. Destructive and remote commands

Ervun lets you issue powerful commands, including remote lock and remote wipe. Some of these actions are irreversible — a wipe permanently deletes data on the target device. You are solely responsible for the commands you send and their consequences. Commands are cryptographically signed on your device before they are trusted, so only you can authorize them. To the maximum extent permitted by law, LeyLance is not responsible for data loss, device impact, or other consequences resulting from commands you choose to issue.

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and use the App and the Ervun agent on devices you control, for your own personal or internal use. We and our licensors retain all right, title, and interest in and to the Service, including all intellectual property. These Terms do not grant you any rights except as expressly set out here.

9. Third-party services

The Service relies on third parties including Supabase (hosting), RevenueCat (subscriptions), and the Apple App Store and Google Play (distribution and payments). Your use of those services may be subject to their own terms and policies. We are not responsible for third-party services and do not control them.

10. Availability and changes

We work to keep Ervun reliable, but we do not guarantee that the Service will be uninterrupted, error-free, or available at all times. Anti-theft outcomes cannot be guaranteed: a device that is powered off, offline, reset, or physically compromised may not receive commands, report its location, or be recoverable. We may modify, suspend, or discontinue features at any time.

13. Indemnification

You agree to indemnify and hold harmless LeyLance and its officers, employees, and suppliers from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any law or the rights of a third party — including any use of Ervun to control a device or person without authorization.

14. Termination

You may stop using the Service at any time, de-enroll your devices, and request account deletion at support@ervun.com. We may suspend or terminate your access if you violate these Terms — in particular the authorized-use requirement in Section 3 — or to protect the Service or others. Provisions that by their nature should survive termination (including Sections 5, 6, 11, 12, 13, 16, and 18) will survive.

15. App-store terms

If you download the App from the Apple App Store, you acknowledge that these Terms are between you and LeyLance only, not Apple, and that Apple is not responsible for the App or its content. Apple has no obligation to provide support or maintenance for the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. Government embargo or designated as “terrorist supporting,” and that you are not on any U.S. Government restricted-parties list. Similar acknowledgements apply to Google Play and other distribution platforms, whose terms also govern your download and use of the App.

For App Store users, the following also apply: Scope of license — your license to use the App is limited to a non-transferable license to use it on any Apple-branded device you own or control, as permitted by the App Store Usage Rules. Maintenance and support — LeyLance, not Apple, is solely responsible for providing any maintenance or support for the App; Apple has no such obligation. Warranty — in the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App; to the maximum extent permitted by law, Apple has no other warranty obligation, and any other claims arising from a failure to conform to a warranty are LeyLance’s sole responsibility. Product claims — LeyLance, not Apple, is responsible for addressing any claims by you or a third party relating to the App, including product-liability, legal or regulatory compliance, and consumer-protection claims. Intellectual property — in the event of any third-party claim that the App infringes intellectual-property rights, LeyLance, not Apple, is responsible for the investigation, defense, settlement, and discharge of that claim.

16. Governing law and disputes

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-laws rules. You agree that the courts located in Ontario, Canada will have exclusive jurisdiction over any dispute, unless applicable mandatory law in your country of residence provides otherwise. Nothing here deprives you of the protection of mandatory consumer-protection laws in your country of residence.

17. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date and, where appropriate, notify you in the App or by email. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

18. General

Severability. If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible and limited or severed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Entire agreement. These Terms, together with our Privacy Policy, are the entire agreement between you and LeyLance regarding the Service and supersede any prior agreements between you and us on that subject.

Assignment. You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms, in whole or in part, in connection with a merger, acquisition, reorganization, or sale of assets, or by operation of law. These Terms bind and benefit the parties and their permitted successors and assigns.

Waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.
